Terms of Service
Last updated: October 13, 2026
These Terms of Service ("Terms") govern your access to and use of the website at www.mscseptic.com and mscseptic.com (the "Website"), operated by Marshall's Septic Care ("Marshall's", "we", "us" or "our"), 4250 Reno Hwy #8377, Fallon, NV 89406. By using the Website, or by submitting a request through it, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Website.
If you use the Website on behalf of a company or other organization, you agree to these Terms on its behalf and confirm you have authority to do so.
1. Use of the Website
The Website is provided to give general information about our services and to let you request a quote or schedule service. You agree to use it only for lawful purposes and in line with these Terms. You agree not to:
- break any law or regulation, or infringe anyone's rights, through the Website;
- submit false, misleading or fraudulent requests, or impersonate any person or business;
- send spam, malware or any harmful code, or attempt to gain unauthorized access to the Website, its servers or any connected system;
- interfere with or disrupt the Website, including by overloading it or by scraping, crawling or copying it with automated tools, other than search engines indexing it for public search;
- harass, threaten or abuse our staff or anyone else.
We may suspend or block access to the Website, or decline any request, at our discretion and without notice.
2. Emergencies
Do not use the contact form for an emergency such as a sewage backup into a home, an overflowing tank or a health hazard. Call us at 775-427-9603. Form submissions are read during business hours and are not monitored around the clock. If there is an immediate danger to people or property, call 911.
3. Requests, quotes and scheduling
Submitting a form, calling, texting or emailing us starts a conversation. It does not create a contract and does not guarantee availability, pricing or a service date. A job is booked only when we confirm it with you directly.
Prices, descriptions, sizes, rental periods and availability shown on the Website are general information, may change without notice, and are not an offer that you can accept. A quote is an estimate based on the information you give us and conditions we can see at the time. The final price can change if the job turns out to be different from what was described, for example because of the condition, size, depth or accessibility of a tank, line or site, the volume or weight of material, or work required by a regulator or inspector. We will tell you before doing additional work wherever that is practical.
You are responsible for giving us accurate information about the job, for having the right to authorize work at the property, and for providing safe, clear access to the work area, tank lids and placement location on the scheduled day. You are responsible for locating and marking private underground utilities, lines, sprinklers and other buried items that public utility locating services do not mark.
4. Communications
By submitting a request through the Website or giving us your phone number or email address, you agree that we may contact you about your request, your service or your rental by phone call, text message or email, including by automated means where the law allows. This consent is not a condition of any purchase. Message and data rates may apply, and message frequency varies. Reply STOP to any text to stop receiving texts, or HELP for help. We do not share mobile numbers or text messaging consent with third parties for their marketing.
5. Services and rentals are governed by their own terms
Septic, grease trap, excavation and other services, and rentals of roll-off dumpsters and portable toilets, are governed by the quote, work order, invoice or rental agreement for that job, including any rental periods, weight limits, overage fees, prohibited materials, damage, cancellation and payment terms stated in it. If those documents conflict with these Terms, those documents control for that job. Some services may be performed by licensed contractors we work with.
Unless your rental agreement says otherwise, rented equipment remains our property, you are responsible for it and for anything placed in it from delivery until pickup, and you must not place hazardous, flammable or otherwise prohibited materials in it. We are not responsible for damage to driveways, lawns, landscaping or other surfaces at a placement location you choose or approve, except where caused by our negligence.
6. Information on the Website is general, not professional advice
Articles, guides, sizing charts, maintenance intervals and other content on the Website are general information for typical situations. They are not engineering, legal, environmental, health or professional advice for your property, and they do not replace an inspection of your system. Septic and wastewater work in Nevada is regulated by state and county authorities, whose requirements vary and change; you are responsible for meeting the requirements that apply to your property. Do not rely on Website content alone to make decisions about your system, and contact us or a qualified professional about your situation.
Reviews and testimonials on the Website reflect individual customers' experiences. They are not a promise that your result will be the same.
7. Intellectual property
The Website and its content, including text, photographs, graphics, logos, charts and design, are owned by or licensed to us and are protected by copyright, trademark and other laws. "Marshall's Septic Care", "Marshall's Sanitation" and our logos are our trademarks. You may view and print pages for your own personal, non-commercial use in connection with our services. You may not copy, reproduce, republish, modify, distribute or create derivative works from any part of the Website, or use our names or logos, without our prior written permission.
8. Your submissions
You confirm that information, photos and other material you send us through the Website are accurate and that you have the right to share them. You give us permission to use what you send to respond to your request and to provide our services. We will handle personal information as described in our Privacy Policy.
9. Third-party links and services
The Website may link to or embed third-party websites and services, such as maps, review platforms and social media. We do not control them and are not responsible for their content, availability, terms or privacy practices. Your use of them is at your own risk and under their terms.
10. Disclaimer of warranties
THE WEBSITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE OR FREE OF VIRUSES, OR THAT ITS CONTENT IS COMPLETE OR CURRENT. Any warranty for services or rentals is only the warranty, if any, stated in writing in the documents for that job.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MARSHALL'S SEPTIC CARE AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE OR ITS CONTENT, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF THOSE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE WEBSITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
This section applies to the Website. Liability for services and rentals is governed by the documents for that job and by applicable law. Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you; in that case they apply to the greatest extent the law allows. Nothing in these Terms limits liability that cannot be limited by law.
12. Indemnification
You agree to defend, indemnify and hold harmless Marshall's Septic Care and its owners, members, managers, employees, contractors and agents from any claims, damages, losses, liabilities, costs and expenses, including reasonable attorneys' fees, arising out of or related to your misuse of the Website, your violation of these Terms, or your violation of any law or the rights of any third party.
13. Governing law and disputes
These Terms and any dispute arising out of or related to them or the Website are governed by the laws of the State of Nevada, without regard to its conflict of law rules. Before filing any claim, you agree to contact us first and try in good faith to resolve the dispute informally for at least 30 days. Any claim that is not resolved informally must be brought exclusively in the state or federal courts located in or serving Churchill County, Nevada, and you and we consent to their personal jurisdiction and venue. Either party may bring an eligible claim in small claims court. To the extent permitted by law, any claim must be brought individually and not as a plaintiff or class member in any class, collective or representative proceeding, and any claim related to the Website must be filed within one (1) year after it arises.
14. Changes to these Terms
We may change these Terms at any time by posting the updated version on this page and updating the "Last updated" date above. Changes take effect when posted and apply to use of the Website after that date. Continuing to use the Website after a change means you accept the updated Terms.
15. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Website. Agreements for specific services or rentals are separate, as described in section 5.
- Severability. If any part of these Terms is found unenforceable, that part will be enforced to the maximum extent possible and the rest will remain in full effect.
- No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours, including as part of a sale, merger or reorganization of our business.
- Events beyond our control. We are not responsible for delay or failure caused by events beyond our reasonable control, including weather, road and site conditions, fire, flood, equipment failure, utility or internet outages, labor shortages, or acts of government.
- Headings. Section headings are for convenience only and do not affect how these Terms are read.
